The full terms below control if anything here is unclear.
1. Who we are and what we do
These Terms of Use ("Terms") are an agreement between you and Internet Marketing Solutions, Inc., a California corporation doing business as WebSEO.pro, 310 Third Ave, Suite A-1, Chula Vista, CA ("we," "us," or "the Company"), for your use of the [App Name] website and web app (the "App").
The App is a free, self guided learning tool. It gives you checklists, lessons, calculators, and progress tracking to help you understand how to build personal credit, set up a business, build business credit, and get ready to apply for business funding. You do every step yourself.
By creating an account or using the App, you agree to these Terms, our Privacy Policy, our Cookie Policy, and our Disclaimers, which are part of these Terms. If you do not agree, do not use the App.
2. Educational purposes only
2.1 Not credit repair. We are not a credit repair organization or credit services organization under the federal Credit Repair Organizations Act or the California Credit Services Act. We do not file disputes for you, contact credit bureaus or creditors for you, or charge any fee. Anything in the App about disputing errors is general education. You have the right to dispute inaccurate information on your credit report yourself, for free, directly with the credit bureaus.
2.2 Not a lender or broker. We do not make loans, arrange loans, or decide who gets approved. If you choose to talk to our funding partner, any loan comes from independent third party lenders who set their own requirements, rates, and terms and make their own decisions.
2.3 No professional advice. Nothing in the App is legal, tax, accounting, investment, or financial advice. Scores, readiness ratings, calculators, playbooks, and funding type suggestions are estimates for learning only. Talk to a licensed professional about your situation.
2.4 No guarantees. We do not promise any change in your credit score, removal of any item, business credit result, loan approval, funding amount, rate, or timeline. Your results depend on your own actions, history, and lender decisions.
2.5 We do not check your credit. The App does not pull your credit report and does not ask for your Social Security number, date of birth, card numbers, or bank account numbers. Do not enter them anywhere in the App.
3. How we make money
The App is free to you. We keep it free in these ways, and we want you to know about each one:
| Source | What it means for you |
|---|---|
| Paid links to free tools | Some links to free tools (for example credit monitoring or credit builder apps) are paid or affiliate links. We may or may not receive a commission if you sign up. They are labeled "Paid link" next to the button. |
| Funding partner referrals | If you choose to talk to our funding partner and a business loan funds, we may receive a referral fee from the broker or lender, including on later loans. This never increases what you pay. You are never required to use our funding partner. |
| Referral partners | If a professional (such as your accountant) referred you, they may receive part of our referral fee or part of what you pay us for marketing services. |
| Marketing services | The Company also operates WebSEO.pro, a marketing agency. If you choose to hire us for website or marketing services, that is a separate paid agreement. You are never required to buy anything. |
Our promise: free options are listed first, paid relationships never change the order of our education or what we recommend you do, and we will never charge you to use the App.
4. Your account
4.1 Eligibility. You must be at least 18 and live in the United States to create an account.
4.2 Accurate information. Give us true information and keep it current. You are responsible for your login and anything done under your account. Tell us right away if you think someone else accessed it.
4.3 Deleting your account. You can request deletion anytime in Profile. We will delete or de identify your information as described in the Privacy Policy, except where the law requires us to keep it.
5. Rules for using the App
You agree not to: (a) enter anyone else's information or Social Security, card, or bank account numbers; (b) use the App for anything illegal or fraudulent, including credit identity schemes like CPNs; (c) copy, scrape, resell, or reverse engineer the App; (d) try to access other users' data or break security; (e) upload harmful code; (f) misrepresent your relationship with us.
We may suspend or close any account that breaks these rules.
6. Communications
6.1 Account messages. By creating an account you agree to receive emails about your account, your plan, and important updates.
6.2 Texts and calls are optional. If you check the separate consent box, you agree to receive calls and text messages, including automated ones, from us and our funding partner at the number you provided, about your journey and services. Consent is not a condition of using the App. Message and data rates may apply. Message frequency varies. Reply STOP to opt out or HELP for help.
6.3 Marketing emails. You can unsubscribe from marketing emails anytime with the link in each email.
7. Referral partners
If you join our referral partner program, a separate Independent Referral Partner Agreement also applies and controls for partner matters. Partners are independent and do not speak for the Company. You can be both a client and a partner with the same email, but you cannot earn on your own funding or your own businesses.
7A. Third party services
The App links to outside websites, tools, lenders, and partners we do not own or control. Their own terms and privacy policies apply. We are not responsible for their content, products, decisions, fees, or data practices. Using them is your choice.
8. Our content
The App, its design, text, lessons, checklists, calculators, and brand are owned by the Company and protected by law. We give you a personal, non transferable, revocable right to use the App for your own learning. You may not copy or redistribute our content without written permission.
9. Privacy
Our Privacy Policy explains what we collect, how we use it, who we share it with (such as our CRM provider and, if you ask, our funding partner), and your California privacy rights, including the right to know, delete, and correct your information and to opt out of any sale or sharing. We do not sell your personal information.
10. Disclaimers
See our Disclaimers page for the full educational, financial, not credit repair, not a lender, paid link, and no guarantee disclaimers.
THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT. WE DO NOT PROMISE THE APP WILL BE ERROR FREE OR ALWAYS AVAILABLE. CREDIT AND LENDING RULES CHANGE, AND CONTENT MAY BE OUT OF DATE.
11. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, THE COMPANY AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND PARTNERS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DENIED CREDIT, LOAN DECISIONS, OR CREDIT SCORE CHANGES, ARISING FROM YOUR USE OF THE APP OR ANY THIRD PARTY SERVICE. BECAUSE THE APP IS FREE, OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO $100. Some states do not allow these limits, so they may not fully apply to you.
12. Indemnity
You agree to cover the Company's losses and reasonable legal fees from any claim caused by your breach of these Terms, your misuse of the App, or your violation of law or anyone's rights.
13. Disputes and arbitration
13.1 Contact us first. Email [Support Email] and we will try to resolve it within 30 days.
13.2 Arbitration. If not resolved, any dispute will be settled by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Consumer Minimum Standards, held remotely or in San Diego County, California. You may instead bring an individual claim in small claims court. You and the Company waive any right to a jury trial or to join a class action.
13.3 Opt out. You can opt out of arbitration by emailing us within 30 days of creating your account.
13.4 Governing law. California law applies, without regard to conflict of law rules.
14. Changes and general terms
We may update these Terms. We will post the new date and, for material changes, notify you by email or in the App. Continuing to use the App means you accept the update. If any part is unenforceable, the rest still applies. These Terms, the Privacy Policy, the Cookie Policy, and the Disclaimers are the full agreement between us about the App.
